In 2016, Guillermo Robles, a blind man, was unable to order a Domino’s Pizza online because the website was not accessible. He sued the company, alleging it violated Title III of the Americans with Disabilities Act (ADA). In the five years since he filed his lawsuit, he has appealed to the Ninth Circuit to reverse a district court’s dismissal of the case, resulting Domino’s filing a (denied) petition for certiorari. The most recent decision, on June 23, 2021, granted Robles’ motion for summary judgment on the ADA claim — but only for the website. The case will continue for Domino’s mobile app.
The court was unable to find a single expert (including the one put forth by Domino’s) who was able to confirm that the site was accessible. As a result, the ruling ordered Domino’s to “bring its website into compliance with the WCAG 2.0 guidelines.”
